Compliance Question Of The Week
For the weeks of: March 3, 2004 to March 15, 2004
Questions:
Question #1: What is the sanction for a student-athlete who participates in any gambling activities prohibited by NCAA legislation?
Question #2: What is a potential sanction for an athletics staff member who participates in any gambling activities prohibited by the NCAA?
Question #3: Provide an example of a prohibited gambling activity by a student-athlete or staff member.
Answers:
Question #1:
The following sanctions for violations of Bylaw 10.3 shall apply as follows: (Adopted: 4/27/00 effective 8/1/00)
(a) A student-athlete who engages in activities designed to influence the outcome of an intercollegiate contest or in an effort to affect win-loss margins (i.e., "point shaving") or who solicits or accepts a bet or participates in any gambling activity through a bookmaker, a parley card or any other method employed by organized gambling that involves wagering on the student-athlete's institution shall permanently lose all remaining regular-season and postseason eligibility in all sports.
(b) A student-athlete who solicits or accepts a bet or participates in any gambling activity that involves intercollegiate athletics or professional athletics, through a bookmaker, a parlay card or any other method employed by organized gambling, shall be ineligible for all regular-season and postseason competition for a minimum of a period of one year from the date of the institution's determination that a violation has occurred and shall be charged with the loss of a minimum of one season of competition. A request for reinstatement may be submitted on behalf of a student-athlete who has participated in such activity only upon fulfillment of the minimum condition indicated above. If the student-athlete is determined to have been involved in a subsequent violation of any portion of Bylaw 10.3, the student-athlete shall permanently lose all remaining regular-season and postseason eligibility in all sports.
Question #2:
Potential sanctions include: a letter of reprimand sent to the employee and place in his/her file, suspension (with or without pay), and/or termination.
Question #3:
Examples provided by coaches and staff who responded (that I can print anyway) include: Participation in a March Madness bracket that has both a risk and a reward ($1 entry fee and the winner(s) take the (or share) the pool); participation in a fantasy baseball or football league; providing information on an IU team and/or student-athlete to someone who will use that information for gambling purposes.
