Compliance Question Of The Week
Question:
Can a coach send a graduation gift/card to a prospect if the prospect has signed an NLI with IU?
Answer:
No, even though the prospect has signed an NLI, you may only send the prospect the permissible recruiting materials listed in 13.4.1. A gift would be considered an impermissible inducement per 13.2. It would be permissible to send a graduation card provided the card is considered the institutional note card (not a store bought card) or you may send an e-greeting card provided there is no cost to send the card and there is no motion/audio.
Question:
Can a coach/institutional staff member have contact with a prospect who is visiting Bloomington for a few days and staying with his/her friend who is a current IU student-athlete and lives off-campus?
Answer:
No, if the prospect is coming to Bloomington to visit his/her friend who is an IU student-athlete, a coach/institutional staff member may not have any contact with the prospect or be involved in arranging the visit. If such contact/arrangement occurs, the visit would count as an unofficial visit, and then IU student-athletes would not be permitted to have any off-campus contact with the prospect during his/her visit (e.g., cannot eat with prospect off-campus, prospect may not stay at IU student-athlete's home/apartment). This is true EVEN if the prospect and the current IU student-athlete have been friends previous to the visit. A prospect can come to Bloomington to visit his/her friend(s) who is a current IU student-athlete and have no contact with a coach/staff member, or a prospect can come on an unofficial visit, with no off-campus contact with current student-athletes, BUT THEY CAN'T DO BOTH at the same time!
