Summer Employment for Current Student-Athletes and Incoming Prospects

Today's topic covers summer employment - for both our current student-athletes and incoming prospects. Here is the Q & A:
Q: Can my current student-athletes get a job for the summer? What are the parameters?
A: Yes! All current IU student-athletes are eligible to seek employment during the summer OR academic year. They must be paid the going rate for their position, and must be paid only for work which is actually performed. Like other employees, student-athletes are eligible for bonuses, raises or other performance incentives, provided they are not established simply because of the employee's status as a student-athlete. Student-athletes may not receive any extra benefits through their employer, so anything provided must be available to all staff, and cannot be given based on the employee's athletics reputation or ability.
Employment (including at camp) may not be a mandatory part of their team participation as mandatory hours could be countable against total ARA hours. Like all things in summer: it's voluntary!
All IU student-athletes wishing to work must complete the attached employment permission form and return to Kathy Arnold for any jobs they hold during the summer or academic year.
(And yes, assuming it's a bona fide job/work as above, Athletic Department staff members may employ our student-athletes. Please document that).
12.4.1 Criteria Governing Compensation to Student-Athletes
Compensation may be paid to a student-athlete: (Revised: 11/22/04) (a) Only for work actually performed; and (b) At a rate commensurate with the going rate in that locality for similar services.
12.4.1.1 Athletics Reputation Such compensation may not include any remuneration for value or utility that the student-athlete may have for the employer because of the publicity, reputation, fame or personal following that he or she has obtained because of athletics ability.
Q: What about my incoming freshmen or transfers arriving this summer who may need some spending money? Can I help them get a job?
A: Once a prospect has graduated from high school (or completed their academic year at a previous institution prior to transfer) our staff is able to help secure paid positions for our incoming student-athletes. This includes reaching out to local businesses who may be able to assist in arranging work for these individuals. We cannot arrange work through boosters, but it is permissible for incomers to work for a booster when hired independently. The same rules apply as for current student-athletes; they must be paid the going rate for the position and paid only for work actually performed. Remember that neither regular prospects NOR transfers can work at, volunteer at , or "play-in" at your camp. Everyone (but FB) can have their incomers pay regular fee to ATTEND camp as a regular camper, but nothing more.
13.2.3.3 After Completion of Senior Year. An institution may arrange for employment or employ any prospective student-athlete (regardless of athletics award winner status), provided the employment does not begin prior to the completion of the prospective student-athlete's senior year in high school. Staff Interpretation Prospective Student-Athlete Employed by Representative of Athletics Interests Date Published: August 18, 2004 Interpretation: The membership services staff confirmed that employment of a prospective student-athlete, regardless of recruited or athletics award winner status, by a representative of the institution's athletics interests would not be considered an improper recruiting inducement, provided the institution does not arrange the employment, the opportunity for employment is available on an equal basis to all applicants who qualify for the position and the prospect is paid only for work performed and at a rate commensurate with the going rate in that locale for similar services.
Q: Can current student-athletes provide individual or group lessons in their sport?
A: Yes, and it's easiest just to quote the bylaw here:
12.4.2.1 Fee-for-Lesson Instruction. A student-athlete may receive compensation for teaching or coaching sport skills or techniques in his or her sport on a fee-for-lesson basis, provided: (a) Institutional facilities are not used; (b) Playing lessons shall not be permitted; (c) The institution obtains and keeps on file documentation of the recipient of the lesson(s) and the fee for the lesson(s) provided during any time of the year; [use attached form again please] and (d) The compensation is paid by the lesson recipient (or the recipient's family) and not another individual or entity. (e) Instruction to each individual is comparable to the instruction that would be provided during a private lesson when the instruction involves more than one individual at a time. (f) The student-athlete does not use his or her name, picture or appearance to promote or advertise the availability of fee-for-lesson sessions.
